Terms and Conditions of Use of the Awush Service

This document (hereinafter referred to as the “Terms and Conditions”) governs the use of the Awush web service, available at https://awush.com (hereinafter referred to as the “Service”), and defines the rights and obligations of users (hereinafter referred to as the “User”) and the Service owner—Yaroslav Aleksandrovich Gorin, registered as a self-employed individual (Tax ID: 343103572224) (hereinafter referred to as the “Owner”).

Any use of the Service (including registration, logging into the account dashboard, configuring campaigns, or making payments) constitutes the User’s full and unconditional acceptance of these Terms and Conditions. If you do not agree with them, please refrain from using the Service.


1. General Provisions

1.1. Awush is a cloud-based SaaS platform designed to collect subscribers from websites and send them web push notifications.

1.2. The Service provides tools for: integrating a subscription widget/button, managing audiences, creating and scheduling push campaigns, configuring automated notification flows, segmenting subscribers, integrating RSS feeds, using the API, and setting up custom domains.

1.4. These Terms and Conditions apply to both individuals and legal entities.

2. Service Owner

2.1. The Service is owned and operated by Yaroslav Aleksandrovich Gorin, registered as a self-employed individual (Tax ID: 343103572224).

3. Registration and Account

3.1. To use the Service, the User must register and create an account.

3.2. The User undertakes to provide accurate, complete, and up-to-date information.

3.3. The User is fully responsible for the security of their account credentials and for all actions performed under their account.

3.4. The minimum age for using the Service is 18 years.

4. Description of Services Provided

4.1. The Owner grants the User access to the following Service features:

  1. Embedding a subscription widget or button on the User’s website;
  2. Collecting and storing subscriber data (in compliance with explicit opt-in consent);
  3. Creating, editing, and sending web push notifications;
  4. Configuring automated notification sequences (flows);
  5. Segmenting audiences based on behavior and parameters;
  6. Integrating RSS feeds to automatically send notifications upon new content publication;
  7. Scheduling recurring campaigns;
  8. Using the API for programmatic integration;
  9. Setting up custom domains and personalized branding.

5. Pricing Plans and Payment

5.1. The Service offers a free plan and paid plans (“Standard,” “Premium”), described at: https://awush.com/plan .

5.2. The free plan is available indefinitely but includes functional and quantitative limitations.

5.3. Payments are made in Russian Rubles (₽) via payment systems integrated on the website.

5.4. Payment is considered complete upon confirmation by the payment provider.

5.5. After payment, the User gains access to all features of the selected plan.

6. Refunds

6.1. Refunds are possible within 3 (three) calendar days from the date of payment, provided one of the following conditions is met:

  1. The User has not used any paid features (e.g., has not sent push notifications, created campaigns, used the API, configured flows, etc.);
  2. The User encountered technical issues preventing proper use of the Service.
  3. 6.2. Refund requests must be submitted exclusively via the contact form: https://awush.com/contact .
  4. 6.3. Refund decisions are made within 5 business days.
  5. 6.4. No refunds are issued if the User has violated these Terms and Conditions.

7. User Rights and Obligations

7.1. The User agrees to:

  1. Use the Service in compliance with the laws of the Russian Federation;
  2. Obtain explicit and voluntary opt-in consent from website visitors before collecting subscribers;
  3. Refrain from sending spam, fraudulent, illegal, malicious, or rights-infringing content;
  4. Respect copyright, personal data rights, and other third-party rights;
  5. Not attempt unauthorized access to the system, other users’ data, or the Service’s internal infrastructure.
  6. 7.2. The User bears full responsibility for the content and consequences of sent notifications.

8. Owner’s Liability

8.1. The Service is provided “as is,” without any warranties.

8.2. The Owner does not guarantee:

  1. Uninterrupted or error-free operation of the Service;
  2. 100% delivery of notifications (due to browser, OS, network, or end-user behavior limitations);
  3. Compatibility with all CMS platforms, website builders, or hosting providers;
  4. Protection against notification blockers or actions by third parties.
  5. 8.3. The Owner’s total liability is limited to the amount paid by the User in the preceding 3 months.
  6. 8.4. This limitation does not apply in cases expressly prohibited by Russian law.

9. Intellectual Property

9.1. All rights to the software, design, logos, API, documentation, and other Service elements belong to the Owner or its licensors.

9.2. The User is granted a limited, non-exclusive, non-transferable license to use the Service within the scope of their selected plan.

9.3. Copying, decompiling, modifying, distributing, or commercially using any Service components without the Owner’s written permission is prohibited.

10. Privacy and Personal Data

10.1. The Privacy Policy is published separately and available at: https://awush.com/page/en-privacy .

10.2. The Owner does not access or control the content of notifications or data uploaded by the User.

10.3. The User is solely responsible for the legality of collecting, storing, and using their subscribers’ data.

11. Termination of Access

11.1. The User may delete their account at any time via the account dashboard.

11.2. The Owner may suspend or block access without prior notice in the event of:

  1. Violation of these Terms and Conditions;
  2. Sending spam or illegal content;
  3. Detection of fraudulent or suspicious activity.
  4. 11.3. No refunds are issued upon account suspension or blocking.

12. Technical Support

12.2. Average response time: up to 5 business days.

12.3. Support does not include assistance with website-side integrations unless the issue stems from a Service error.

13. Amendments to Terms and Conditions

13.1. The Owner reserves the right to amend these Terms and Conditions.

13.2. Updated versions are published on the website with an effective date.

13.3. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13.4. Users will be notified of material changes via email or through the dashboard.

14. Governing Law and Dispute Resolution

14.1. These Terms and Conditions are governed by the laws of the Russian Federation.

14.2. All disputes shall be resolved through negotiations.

14.3. If no agreement is reached, disputes shall be submitted to a court located at the Owner’s registered address (available upon request via the contact form).

15. Miscellaneous

15.1. These Terms and Conditions are drafted in Russian. In case of translation into other languages, the Russian version prevails.

15.2. Nothing herein creates partnership, agency, employment, or other legal relationships between the User and the Owner.

15.3. If any provision is deemed invalid, the remaining provisions remain in full force.
